KOSTENFREIES VCA Webinar: Verabreichung von Cannabisblüten und -extrakten mittels Verdampfern – Was ist zu beachten?

Medizinischer Cannabis (Blüten oder Extraktzubereitungen) werden häufig zum Verdampfen an Patienten abgegeben oder mittels Verdampfung verabreicht. Die dabei verwendeten Verdampfer müssen nach der Europäischen Medizinprodukteverordnung eine CE-Zertifizierung als Medizinprodukte haben.
Der Nachweis der Konformität von Verdampfern (und ggf. Kartuschen) hinsichtlich der Sicherheits- und Leistungsanforderungen liegt in der Verantwortung der Hersteller oder anderer Wirtschaftsakteure. Die Verdampfer müssen zukünftig außerdem mit einer UDI-Nummer (Unique Device Identifier) versehen und im elektronischen System EUDAMED registriert werden. Die als Medizinprodukte nach den bisherigen Regelungen zertifizierten Verdampfer können im Rahmen einer Übergangsregelung weiter in den Verkehr gebracht werden und in Apotheken mit Medizinischem Cannabis abgegeben werden. Die Kosten für zertifizierte Verdampfer werden auf Antrag von den Kassen erstattet.
Verdampfer, die mit der Zweckbestimmung abgegeben (oder in Verkehr gebracht) werden, Medizinisches Cannabis zu verabreichen und die nicht zertifiziert sind, dürfen nach § 93 Abs. 3 MPDG im medizinischen Kontext nicht in Betrieb genommen werden, und deren Inverkehrbringung kann behördlicherseits untersagt werden. Das gilt ggf. auch für Kartuschen, die in Apotheken als Defekturarzneimittel mit Extrakten befüllt werden. Im Einzelfall kann sich ein Strafbarkeitsrisiko – auch für die abgebende Apotheke - ergeben. Dieses Spannungsfeld verschärft sich zurzeit weil Verdampfer und Kartuschen angeboten und in den Verkehr gebracht werden, die die bestehenden Anforderungen nicht erfüllen.
Es wird im Rahmen des Webinars im Detail dargestellt auf welche formalen Kriterien geachtet werden muss und wie sichergestellt werden kann, dass Großhändler und Apotheken ihren legalen Obliegenheiten gerecht werden.
